Terms of Service

By commissioning me (Yahikyun) in any kind of way,
you (the client) are agreeing to the terms of service below.

_{Any statement can be bound to change if discussed with me, prior to the commission.}I. GENERAL TERMS.◇ All commissions are digital. I will not ship anything physical to you.◇ Kindly provide neat references or clear instructions.
Communication between us, client & artist is very important.◇ I reserve the right to cancel a commission due to rude or ill behaviour from the client, or any other similar circumstances that I will not tolerate.◇ Please take note of my Dos & Don'ts.

II. PAYMENT◇ All commissions must be paid in full upfront via PayPal.
◇ All prices are listed in United State Dollars (USD).
◇ Commission prices are subject to change at any time.
^{Ongoing commissions will not be affected by any changes in pricing before its completion.}III. PROCESS◇ Work In Progress will only be given if the commissioner personally ask for it. WIPs might be given as well, if I the artist, feel the need to update you on it, such as inquiring about more details and client's opinions.◇ The time for your commission to be completed can be up to 6 months depending on many factors such as;
Health, order of commission, complexity, work or family issues.
^{If any of the things stated above occurs, you will be notified for any possible delays.}IV. CUSTOMER SATISFACTION◇ After a commission is finished, only small changes & adjustments are allowed to be made.◇ Any major changes will come with an extra charge. I reserve the rights to charge an additional fee if I considered the changes to be over my workload limit.
^{(i.e. Redrawing an entire outfit, multiple major changes, extra complex request & etc.)}Please keep in mind to have a clear reference to start with, make sure to clearly convey what you aim for. I'm always open for discussions.V. COPYRIGHT / USAGE POLICYI, the artist, hold every right to the produced drawing, VRoid model & video that I'm commissioned to create.
Therefore I´m allowed to use the copyrighted artwork to;
◦ Promote myself with in any place or site.
◦ To display it anywhere to my liking.
◦ Post it wherever I want.The commissioner are allowed to;
◦ Use the copyrighted artwork for PERSONAL USE ONLY unless discussed and agreed otherwise.
◦ Print the art, use the model in VR chat/MMD and claim the right of their character(s) but not the drawing, VRoid model & video itself.
◦ Use the commissioned work to promote themselves with proper credit given to me, the artist.^{If you break the copyright infringement in any way, every right you had to the commissioned work will be retracted.}The following is considered Copyright infringement:◦ Reproducing/using the copyrighted artwork commercially.
^{(i.e. Selling the VRoid model without my acknowledgement)}
◦ Taking Credit for the creation of the artwork.
◦ Removing any watermarks/signatures.
◦ Altering the artwork without my, the artist´s, consent.
^{(However, model file conversion is allowed but I appreciate it if you notify me.)}Additional Note
^{※ Clients are not permitted, under any circumstances, to use any part of their commissioned work for Non-Fungible Tokens or any cryptocurrency. Use of the artwork/model/video for any advertising or profits associated with Non-Fungible Tokens or any cryptocurrency is strictly prohibited.}VI. CANCELING/REFUNDING POLICYI have the right to cancel your commission and issue a refund at any time.
You have no right to cancel or demand a full refund from me, the artist under any circumstances after payment are received.If money has not been sent yet the commissioner has the right to cancel the commission.^{※If a commission is cancelled under the circumstances of financial difficulty, a partial refund may be issued according to the commission progress I determined:
☆ 0% - 20% : 50% refund
☆ 21% - 50% : 30% refund
☆ 51% - 70% : 10% refund
☆ 71% - 100% : 0% refund
But please make sure you are financially stable before commissioning anyone!}If you file a chargeback against me, your right to everything I have ever made for you will be retracted and I have the right to sell the copyrighted artwork to new buyers.
Your name will be blacklisted & publicly displayed everywhere for others to watch out for.I also have every right to file a complaint and I have all the right to the money I received after a commission is confirmed and the transaction for the payment is completed.
